Michael Diller is a committed advocate for workers’ rights. He represents individuals and classes of employees across industries in federal and state court litigation, in cases involving wage theft, discrimination, retaliation, and other employment-related legal issues. He also has experience representing employees in proceedings before administrative agencies, mediations, arbitrations, and pre-suit settlement negotiations.

Before joining Menken, Simpson & Rozger, Mr. Diller was a staff attorney in the Employment Law Unit of The Legal Aid Society. There, he represented low-wage workers in a wide variety of employment matters, with a particular focus on assisting clients in the homecare and building services industries. Mr. Diller worked on the litigation team in Calderon v. Public Partnerships LLC, a wage and hour class action which resulted in an over $160 million dollar settlement for a class of around 200,000 personal care assistants working in New York State’s Consumer Directed Personal Assistance Program. Mr. Diller was also one of the class counsel in Chen v. Reardon, an Article 78 action which successfully challenged the New York State Department of Labor’s failure to investigate wage theft complaints made by homecare aides working 24-hour shifts. In addition to his work representing clients, Mr. Diller also sought to advance the interests of workers by advocating for legislative reforms and drafting amicus curiae briefs in appellate cases affecting employee rights.

Mr. Diller began his career advocating for low-wage workers in wage theft and discrimination claims at Bronx Legal Services, where he was first a NYU Public Interest Law Center Fellow and subsequently a staff attorney. He graduated from the New York University School of Law magna cum laude. In law school, he served as a senior articles editor on the NYU Review of Law and Social Change, as well as regional president of the Unemployment Action Center, a student-run legal services organization representing claimants in unemployment Insurance appeals.
