Our Civil Rights Practice
The attorneys of Menken Simpson & Rozger have a long history of vindicating the rights of individuals who had their Constitutional rights violated. These include cases brought on behalf of people falsely arrested, beaten and injured by police and corrections officers, and who were violated by unlawful strip searches. In addition, our firm has been involved in impact litigation to challenge anti-LGBTQ laws.
Notable Civil Rights Cases
Grottano v. The City of New York, No. 15-CIV-9242(RMB)(KNF) (S.D.N.Y): in partnership with the NAACP Legal Defense Fund, attorneys from Menken Simpson & Rozger brought a class action on behalf of visitors to the New York City jails who were subject to invasive searches while visiting their family and friends. This case is soon to result in a multi-million dollar settlement for the class.
Krupa v. Badolato, No. 16-cv-4637 (D.N.J), a landmark infertility treatment coverage lawsuit on behalf of New Jersey women in same-sex relationships, which resulted in a change to New Jersey law in favor of our clients and those seeking reimbursement for fertility treatments.
Kahler v. Rensselaer County, No. 1:03–cv–01324 (N.D.N.Y. ): establishing a $2.7 million class action settlement fund for unlawful strip searches in county jail.
McDaniel v. Cty. of Schenectady, No. 04-CV-0757 (N.D.N.Y.): establishing $2 million settlement fund for pre-trial detainees unlawfully strip searched at Schenectady County Jail.
Mitchell v. Cty. of Clinton, No. 06-CV-0254(DRH) (N.D.N.Y.): Class action settlement of $1,150,000 to compensate pre-trial detainees unlawfully strip searched.
